PARTIES TO CONTRACT

The “Branch” means the organisation providing the service for which the Customer is paying being Clublinks Management Pty Ltd Trading As UNSW Fitness& Aquatic Centre. The “Customer” means you: the person or party signing this Contract.

COOLING OFF PERIOD

There is a 7 day cooling off period for all membership types. If a membership is cancelled during the cooling off period, all monies collected will be refunded.

SUSPENSION OF MEMBERSHIP

All memberships are entitled to 12-week membership suspension (per calendar year) and any additional suspensions incur $5 fee per suspension period. A Medical Certificate is required to be supplied for all medical suspensions. Medical suspensions are to be used for valid medical reasons only. UNSW Fitness & Aquatic Centre reserves the right to reject any medical suspensions if deemed necessary.

CANCELLATION

Term memberships (where memberships are valid for a set period of time) cannot be cancelled, transferred or refunded. Memberships with no set term have a 28 day cancellation period unless cancelled for medical reasons and where a medical certificate is supplied. A UNSW Fitness & Aquatic Centre cancellation form must be completed. Memberships will be cancelled 28 days from the cancellation request. During the 28 day notice period, all membership fees are payable and access as per the membership type is valid. Cancellation cannot commence during a period of suspension.

ENTITLEMENT

Provision of services provided by the Branch may change and for the purposes of this Contract is based on “entitlement” to use and not on actual use. By signing this agreement you are agreeing to be bound by the rules and conditions of the Branch. The Management at the UNSW Fitness & Aquatic Centre reserves the right to cancel the rights of any member not complying with the conditions of membership or rules of the Branch at any time.

PROVISION OF SERVICE

Change of location or ownership or the name of the Branch does not absolve you of your responsibilities under the terms and conditions of this Contract.

ENTIRE AGREEMENT

This Contract constitutes the entire agreement, understanding and arrangement (express and implied) between you, the Customer, UNSW Fitness & Aquatic Centre relating to the subject matter of this Contract and supersedes and cancels any previous agreement, understanding and arrangement relating thereto whether written or oral.

LIABILITY

To the extent permitted by law, UNSW Fitness & Aquatic Centre shall not be liable or responsible to you for any direct, indirect or consequential injury, loss or damage whatsoever and however arising. UNSW Fitness & Aquatic Centre is not responsible for lost or stolen items or damage to property or vehicles. Acknowledging this risk, you agree to use the Branch at your own risk.

PRIVACY DISCLAIMER

UNSW Fitness & Aquatic Centre from time to time will send you news and information regarding the centre. You can unsubscribe at any time using the link at the bottom of our emails or by contacting UNSW Fitness & Aquatic Centre. UNSW Fitness & Aquatic Centre will only keep on file personal information that is needed to provide the requested updates or service to you. You may request to see your personal information held on file by us. UNSW Fitness & Aquatic Centre will not sell or give your personal information to any third parties without your express consent, unless we have to do so to provide the requested service or as required by law. The data provided may be provided to UNSW or any other person from time to time who is engaged to manage and operate the centre. If you do not wish to receive these updates, you may unsubscribe at anytime. UNSW Fitness & Aquatic Centre will collect event data using the UNSW Student Card Reader system. By swiping your card, you give consent for your contact details to be passed onto UNSW Fitness & Aquatic Centre by UNSW Card. This data will not be used for any marketing or communication purposes not directly related to this event, and will be used in accordance with the NSW Privacy and Personal Information Protection Act 1998.

Terms & Conditions of participation in the UNSW Swim School Program delivered by Clublinks Management PTY LTD (Clublinks) on behalf of the University of New South Wales (UNSW) at the UNSW Fitness & Aquatic Centre.
Clublinks on behalf of UNSW reserves the right to amend these Terms & Conditions from time to time as and when required. Clublinks on behalf of UNSW reserves the absolute discretion to terminate participation in any of the UNSW swim school programs at any time for any reason.

1. ENQUIRIES
a. All enquiries should be directed to swimschool@unswfac.com.au
b. If you require information regarding your child’s progress, please contact the Aquatic Programs
Manager in person at the reception desk or via email.
c. Due to time constraints and in the interest of all swimmers if you would like to speak to an instructor or
coach please email swim school and the information will be passed to them.

2. APPLICATIONS
a. Application forms must be completed and signed by a parent or guardian or a responsible adult over
the age of 18 years.
b. All swim school participants, except preschool and non-swimmer participants, must be assessed
before joining any swim school program. For a complimentary swim assessment please contact
swimschool@unswfac.com.au to arrange a suitable time and date.
c. Places in swim classes & squads are subject to availability and at the discretion of Clublinks on behalf
of UNSW.
d. All relevant medical information for each participant must be declared at the time of application.

3. PHOTOGRAPHY AND VIDEO RECORDING
a. No photography or video recording is permitted in the UNSW Fitness & Aquatic Centre. Written
management approval needs to be organised in advance of such request.

4. PAYMENTS
a. UNSW Swim School payments will be done via direct debit in accordance with our weekly direct debit
payment cycle.
b. UNSW Swim School operates on a rolling basis. Direct debits will be automatically paused for
shutdown periods.
c. UNSW swim school doesn’t operate on public holidays and debits will be credited for those sessions
d. All participants will receive a UNSW FAC membership card to be presented on arrival at the reception
desk for lesson attendance to be recorded.
e. UNSW Swim School Program Fees payable are subject to change at any time.

5. DISCOUNTS
a. UNSW Swim School offer a discount for families who have two or more children (15% discount for first
child, 20% discount for second child) who are Learn to Swim participants within the UNSW Swim
School program.
b. UNSW Swim School offer a discount (15%) for Learn to Swim participants who book 2 or more swim
lessons per week.
c. There are no other discounts available for any other programs offered by UNSW Swim School.
d. The above discounts cannot be combined or used in conjunction with one another.
e. The discounts offered are subject to change without notice.

6. CREDITS
a. Requests for credits must be made via email to swimschool@unswfac.com.au and will be at the
discretion of the Aquatic Programs Manager.
b. UNSW Swim School, as a courtesy, offer complimentary make-up lessons when 24 hours’ notice is
given via email or on receipt of a medical certificate.
c. UNSW Swim School does not offer any form of credit or refund for lost or missed swim lessons.
d. Refunds will not be given for partial attendance of any lesson, nor will make-up lessons be provided.
e. All make-up lessons are subject to availability and are at the discretion of the Aquatic Programs
Manager.
f. UNSW Swim School cannot guarantee the provision of make-up classes for Special Needs or one-onone lessons at any particular time.
g. Make-up lessons will be terminated before every suspension, with no make-up lesson being able to be
booked more than seven days in advance.

7. SPECIAL NEEDS PROGRAM
a. UNSW Swim School offers a Special Needs swim program for children who are assessed by UNSW
Swim School as being unable to join a group lesson due to a disability.
b. Special Needs classes are conducted on a one-on-one basis, and participants are offered a significant
discount as compared to the usual rate for one-on-one classes.
c. Given the discounted arrangement that applies to Special Needs classes, the volume discounts set out
above do not apply to Special Needs classes.
d. UNSW Swim School cannot guarantee the provision of one-on-one make-up classes.

8. REFUNDS
a. All requests for refunds must be made in writing via email to swimschool@unswfac.com.au and will
be at the discretion of the Aquatic Programs Manager.
b. Refunds will only be given if lessons cannot be attended for medical reasons which must be supported
by a medical certificate or moving over 10km out of the area.

9. CONDITIONS OF POOL USAGE
a. The health, safety and well-being of all participants and staff are paramount; all participants and
parents must follow safety guidelines and instructions given by any member of Clublinks staff on behalf
of UNSW. This may include reinforcing clear guidelines.
b. All participants must adhere to the UNSW Fitness & Aquatic Centre Facility Code of Conduct. Breach
of this Code may lead to termination of participation in the UNSW Swim School Program. By
completing and signing this application form you have read and understood these terms and conditions
and the UNSW Fitness & Aquatic Centre Facility Code of Conduct which is available on the UNSW
FAC website www.unswfac.com.au
c. Parents with children under the age of 16 years must escort their children into the facility and remain
with their child in view while the child is participating in lessons.
d. Parents and guardians are expected to take full responsibility for their children upon entry to UNSW
Fitness & Aquatic Centre. Clublinks, on behalf of UNSW, does not take any responsibility for the
supervision of children outside of their allocated swimming lesson. UNSW Swim School families are
required to maintain appropriate behaviour whilst within the UNSW Fitness & Aquatic Centre. All
children must be supervised at all times outside of their swimming lessons.
e. UNSW Swim School reserves the right to refuse to allow participation of anyone suffering from or
displaying symptoms of any illness including but not limited to contagious diseases. If your child is
suffering from a contagious illness or infection, please do not bring them to the facility. UNSW Swim
School reserves the right to refuse entry to any child or adult.
f. Swimming caps must be worn by ALL participants at all times during lessons.
g. To swim before or after any swim school program, all supervising responsible persons, parents,
caregivers and participants must be present.
h. Any person not enrolled in the swim school must pay the required additional fee to use the pool.
i. No running around the pool hall area.
j. No glass bottles are permitted in the pool hall area.
k. Appropriate swimming attire is required at all times.

10. CANCELLATIONS & SUSPENSIONS
a. UNSW Swim School requires minimum 28 days’ notice in writing to swimschool@unswfac.com.au
in order to cancel direct debit payments.
b. A suspension period must be a minimum of 7 days.
c. A suspension period can be no longer than 28 days.
d. You are not permitted to use the centre during a suspension period.
e. UNSW Swim School requires minimum 14 days’ notice in writing to swimschool@unswfac.com.au
in order to suspend direct debit payments.

11. PRIVACY
A customer’s “personal information”(as the term is defined in the privacy act 1988(Cth)) will only be used by
the centre or Club Links to provide you with the service contemplated by the Direct Debit request and
contract or in accordance with your selection relating to the privacy disclaimer on the front page of the
direct debit request and contract.

12. ASSESSMENTS
Assessments are completed on an ongoing basis throughout the term. If you have any concerns about the
way your child’s lesson is being taught, please raise your concerns with the pool deck supervisor, or
email swimschool@unswfac.com.au

RELEASE
I am aware that recreational, fitness and sporting activities carried out by Clublinks on behalf of UNSW at
the UNSW Fitness & Aquatic Centre, including but not limited to the UNSW Swim School Program, are
dangerous undertakings and in undertaking such activities do so at my minor child/children’s own risk. I
recognize that such activities require physical exertion which may be strenuous and may cause physical
injury and I am fully aware of the risks and hazards involved.

I am also aware that Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre, its directors,
instructors, members, servants or agents are absolved from all liability howsoever arising from injury
(whether fatal or otherwise) or damage (including to property), howsoever caused arising out of
involvement with Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre or from participating
in any of the sporting, fitness and recreational activities offered by Clublinks on behalf of UNSW at the
UNSW Fitness & Aquatic Centre, or in any way whatsoever due to any negligent act, breach of duty,
default and/or omission on the part of Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre,
its directors, instructors, members, servants or agents.

I voluntarily agree to assume the risk of any injuries, damages or loss, regardless of severity that my minor
child/children’s or I may sustain as a result of being a participant in the activities connected with or
associated with my minor child/children’s or own involvement with the UNSW Swim School Program.
By participating at UNSW Fitness & Aquatic Centre, I am aware that there could be photography taken in
which I or my dependents appear to be used for media, electronic (including social media) and marketing
purposes.

Notice

3 days’ notice is required prior to beginning of suspension period.

Suspension Entitlements

All twelve month memberships include an entitlement of 12 weeks suspension. Additional suspension periods will incur a $5 fee.

Exceptions

Suspension due to medical issues will not be included in the 12 week suspension entitlement if a medical certificate is supplied.

UNSW Staff

Staff payroll suspensions are done in two week blocks corresponding with the fortnightly pay.

CONDITIONS OF USE

  1. UNSW Fitness & Aquatic Centre requires notification of ALL First Aid Incidents and other general incident (e.g. vandalism, break-ins). UNSW Fitness & Aquatic Centre templates for reporting are available if required. These should be forwarded to UNSW Fitness & Aquatic Centre within 24 hours after the injury/incidents occurs.
  2. Food and drink (other than water) are not permitted on any of the playing surfaces.
  3. Smoking is NOT permitted on University Campuses.
  4. Alcohol must NOT be consumed at the venue or its environs. Intoxicated persons will not be granted admission.
  5. The use of cameras for photography or videoing is NOT permitted without written permission from UNSW Fitness & Aquatic Centre.
  6. The use of mobile phones and cameras are NOT permitted in change rooms.
  7. The facility encourages access to all individuals. Any individual or group who, through their behaviour limits the enjoyment or other users, will be asked to leave the facility.
  8. Users are asked to ensure that they assist in maintaining a clean facility.
  9. Animals (with the exception of assistance dogs) may not enter the venue.
  10. Users shall follow all reasonable instructions given by management of the UNSW Fitness & Aquatic Centre in the interests of Risk Management and the enjoyment of others at the facility.
  11. Users will be liable for the cost of repairs for any damage caused to the facility as a direct result of their activities, or activities undertaken by their participants.
  12. User are asked to wear closed-toed shoes while in the gym.
  13. Users are asked to put equipment back when finished with it.
  14. Appropriate gym attire must be worn at all times.
  15. Sanitize equipment once finished use.

$30 for 30 Days – Terms and Conditions

The terms and conditions listed below are applicable in conjunction with all other UNSW Fitness & Aquatic Centre terms and conditions.

The $30 for 30 days membership promotion is available for redemption until close of business on Monday 31 May, 2021.

This offer is not valid to current members of the UNSW Fitness & Aquatic Centre.

Membership is applicable for 30 consecutive days from sign up. No suspensions of membership can be made during the 30 day membership window.

Payment must be made when signing up for this promotional offer.

Offer can only be redeemed once per new member.

At the end of the 30 period, should you wish to continue using the UNSW Fitness & Aquatic Centre facilities a valid membership or pass will need to be purchased. Membership card will no longer provide entry at the end of the 30 day period.
