PARTIES TO CONTRACT
The “Branch” means the organisation providing the service for which the Customer is paying being Clublinks Management Pty Ltd Trading As UNSW Fitness& Aquatic Centre. The “Customer” means you: the person or party signing this Contract.
COOLING OFF PERIOD
There is a 7 day cooling off period for all membership types. If a membership is cancelled during the cooling off period, all monies collected will be refunded.
DIRECT DEBIT MEMBERSHIPS
All direct debit memberships are perpetual, and payments will continue past the agreed commitment period as stated and signed for on the direct debit request form at the time of joining. Should a member wish to cancel their membership within an agreed contract term period, the member will be required to pay out the remainder of the contract term. Members can cancel within a contract period without penalty should the request be due to a medical condition or moving more than 10km from UNSW FAC. Proof is required via a medical certificate or rental agreement or utility bill for the cancellation request to be accepted. Terms and conditions attached to respective Direct Debit request form completed and signed for at the time of joining are binding.
SUSPENSION OF MEMBERSHIP
All memberships are entitled to 12-week membership suspension (per calendar year). A Medical Certificate is required to be supplied for all medical suspensions. Medical suspensions are to be used for valid medical reasons only. UNSW Fitness & Aquatic Centre reserves the right to reject any medical suspensions if deemed necessary.
Term memberships (where memberships are valid for a set period of time) cannot be cancelled, transferred or refunded. Memberships with no set term have a 28 day cancellation period unless cancelled for medical reasons and where a medical certificate is supplied. A UNSW Fitness & Aquatic Centre cancellation form must be completed. Memberships will be cancelled 28 days from the cancellation request. During the 28 day notice period, all membership fees are payable and access as per the membership type is valid. Cancellation cannot commence during a period of suspension.
Provision of services provided by the Branch may change and for the purposes of this Contract is based on “entitlement” to use and not on actual use. By signing this agreement you are agreeing to be bound by the rules and conditions of the Branch. The Management at the UNSW Fitness & Aquatic Centre reserves the right to cancel the rights of any member not complying with the conditions of membership or rules of the Branch at any time.
PROVISION OF SERVICE
Change of location or ownership or the name of the Branch does not absolve you of your responsibilities under the terms and conditions of this Contract.
This Contract constitutes the entire agreement, understanding and arrangement (express and implied) between you, the Customer, UNSW Fitness & Aquatic Centre relating to the subject matter of this Contract and supersedes and cancels any previous agreement, understanding and arrangement relating thereto whether written or oral.
To the extent permitted by law, UNSW Fitness & Aquatic Centre shall not be liable or responsible to you for any direct, indirect or consequential injury, loss or damage whatsoever and however arising. UNSW Fitness & Aquatic Centre is not responsible for lost or stolen items or damage to property or vehicles. Acknowledging this risk, you agree to use the Branch at your own risk.
UNSW Fitness & Aquatic Centre from time to time will send you news and information regarding the centre. You can unsubscribe at any time using the link at the bottom of our emails or by contacting UNSW Fitness & Aquatic Centre. UNSW Fitness & Aquatic Centre will only keep on file personal information that is needed to provide the requested updates or service to you. You may request to see your personal information held on file by us. UNSW Fitness & Aquatic Centre will not sell or give your personal information to any third parties without your express consent, unless we have to do so to provide the requested service or as required by law. The data provided may be provided to UNSW or any other person from time to time who is engaged to manage and operate the centre. If you do not wish to receive these updates, you may unsubscribe at anytime. UNSW Fitness & Aquatic Centre will collect event data using the UNSW Student Card Reader system. By swiping your card, you give consent for your contact details to be passed onto UNSW Fitness & Aquatic Centre by UNSW Card. This data will not be used for any marketing or communication purposes not directly related to this event, and will be used in accordance with the NSW Privacy and Personal Information Protection Act 1998.
LEARN TO SWIM TERMS AND CONDITIONS
Terms & Conditions of participation in the UNSW Swim School Program delivered by Clublinks Management PTY LTD (Clublinks) on behalf of the University of New South Wales (UNSW) at the UNSW Fitness & Aquatic Centre.
Clublinks on behalf of UNSW reserves the right to amend these Terms & Conditions from time to time as and when required. Clublinks on behalf of UNSW reserves the absolute discretion to terminate participation in any of the UNSW swim school programs at any time for any reason.

If you require information regarding your child’s progress, please contact the Aquatic Programs Manager in person at the reception desk or via email.
Due to time constraints and in the interest of all swimmers if you would like to speak to an instructor or coach please email swim school and the information will be passed to them.
Application forms must be completed and signed by a parent or guardian over the age of 18 years.
All swim school participants, except preschool and non-swimmer participants, must be assessed before joining any swim school program. For a complimentary swim assessment please contact visit UNSW FAC Monday – Friday between 3.30pm and 6.00pm. For weekend assessments, email email@example.com to arrange a suitable time and date.
Places in swim classes & squads are subject to availability and at the discretion of Clublinks on behalf of UNSW.
All relevant medical information for each participant must be declared at the time of application.
PHOTOGRAPHY AND VIDEO RECORDING
Photography and video recording is only permitted when parties and or legal guardians have given permission to do so. Any unlawful photography or videography will result in legal action and police will be contacted.
UNSW Swim School payments will be done via direct debit in accordance with our fortnightly direct debit payment cycle.
UNSW Swim School operates on a rolling basis. Direct debits will be automatically paused for shutdown periods.
All participants will receive a UNSW FAC membership card to be presented on arrival at the reception desk for lesson attendance to be recorded.
UNSW Swim School Program Fees payable are subject to change at any time.
UNSW Swim School offer a discount for families who have two or more children (15% discount for first child, 20% discount for second child) who are Learn to Swim participants within the UNSW Swim School program.
UNSW Swim School offer a discount (15%) for Learn to Swim participants who book 2 or more swim lessons per week.
There are no other discounts available for any other programs offered by UNSW Swim School.
The above discounts cannot be combined or used in conjunction with one another.
The discounts offered are subject to change without notice.
CREDITS & MAKE UP SESSIONS
Requests for credits must be made via email to firstname.lastname@example.org and will be at the
discretion of the Aquatic Programs Manager.
UNSW Swim School, as a courtesy, offer complimentary make-up lessons when 24 hours’ notice is given via email or on receipt of a medical certificate.
UNSW Swim School does not offer any form of credit or refund for lost or missed swim lessons.
Refunds will not be given for partial attendance of any lesson, nor will make-up lessons be provided.
All make-up lessons are subject to availability and are at the discretion of the Aquatic Programs Manager.
All make up lessons will be forfeited upon cancellation, with no make-up lesson being able to be booked more than seven days in advance.
Make up sessions cannot be booked more than 7 days from day of requesting to schedule the make-up session.

DIRECT DEBIT MEMBERSHIPS
All direct debit memberships including Learn to Swim and Squad are perpetual and require 28 days’ notice to cancel otherwise payments will continue passed agreed commitment period as stated on the direct debit request form at the time of joining. Direct debit memberships incur fortnightly surcharges as listed and signed for on the direct debit request agreement form.

All requests for refunds must be made in writing via email to email@example.com and will be at the discretion of the Aquatic Programs Manager.
Refunds take a minimum of 14 days from Program Manager approval.
A customer’s “personal information” (as the term is defined in the privacy act 1988 (Cth)) will only be used by the center or Club Links to provide you with the service contemplated by the Direct Debit request and contract or in accordance with your selection relating to the privacy disclaimer on the front page of the direct debit request and contract.
Assessments are completed on an ongoing basis throughout the term. If you have any feedback on your child’s sessions or progress, please contact the pool deck supervisor, or email firstname.lastname@example.org
SUSPENSION OF SQUAD MEMBERSHIP
(Learn to Swim program members are not entitled to suspend memberships, rather make up sessions are offered) Squad memberships are entitled to 12-week membership suspension (per calendar year). Medical Certificate is required to be supplied should the request be for medical reasons and extend beyond a 12-week period. Minimum 3 days’ notice is required for any suspension request, and this must be submitted via a suspension form at reception or via the UNSW FAC online suspension form located under memberships on our website.
I am aware that recreational, fitness and sporting activities carried out by Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre, including but not limited to the UNSW Swim School Program, are dangerous undertakings and in undertaking such activities do so at my minor child/children’s own risk. I recognize that such activities require physical exertion which may be strenuous and may cause physical injury and I am fully aware of the risks and hazards involved.
I am also aware that Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre, its directors, instructors, members, servants or agents are absolved from all liability howsoever arising from injury (whether fatal or otherwise) or damage (including to property), howsoever caused arising out of involvement with Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre or from participating in any of the sporting, fitness and recreational activities offered by Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre, or in any way whatsoever due to any negligent act, breach of duty, default and/or omission on the part of Clublinks on behalf of UNSW at the UNSW Fitness & Aquatic Centre, its directors, instructors, members, servants or agents.
I voluntarily agree to assume the risk of any injuries, damages or loss, regardless of severity that my minor child/children’s or I may sustain as a result of being a participant in the activities connected with or associated with my minor child/children’s or own involvement with the UNSW Swim School Program.
By participating at UNSW Fitness & Aquatic Centre, I am aware that there could be photography taken in which I or my dependents appear to be used for media, electronic (including social media) and marketing purposes.
3 days’ notice is required prior to beginning of suspension period.
All twelve month memberships include an entitlement of 12 weeks suspension.
Suspension due to medical issues will not be included in the 12 week suspension entitlement if a medical certificate is supplied.
Staff payroll suspensions are done in two week blocks corresponding with the fortnightly pay.
CONDITIONS OF USE
The terms and conditions listed below are applicable in conjunction with all other UNSW Fitness & Aquatic Centre terms and conditions.
The $30 for 30 days membership promotion is available for redemption from Monday 14 March 2022 until close of business on Tuesday 12 April 2022.
This offer is not valid to current members of the UNSW Fitness & Aquatic Centre.
Membership is applicable for 30 consecutive days from sign up. No suspensions of membership can be made during the 30 day membership window.
Payment must be made when signing up for this promotional offer.
Offer can only be redeemed once per new member.
At the end of the 30 period, should you wish to continue using the UNSW Fitness & Aquatic Centre facilities a valid membership or pass will need to be purchased. Membership card will no longer provide entry at the end of the 30 day period.
